			<content:encoded><![CDATA[<p>Phil Calandrino defended the buyer of a small business from a claim against the seller for nonpayment of the seller&#8217;s note. The buyer countersued for fraud because the company&#8217;s gross revenue and net profit were not as they were represented. After a three-day trial, the Calandrino Law Firm won a verdict for the client, wiping out the note, refunding a portion of the purchase price, and requiring the seller to reimburse the buyer&#8217;s attorneys&#8217; fees in full.</p>
<p>The seller appealed and Phil Calandrino argued the case before a panel of three judges at the Fifth District Court of Appeal in Daytona Beach. The Fifth District affirmed the trial court judgment. After the verdict, Calandrino said:  &#8220;I am very happy to see justice done for our client. The court sent a clear message to business sellers that you must be honest in your dealings with buyers and that hiding behind the doctrine of due diligence won&#8217;t protect you from false statements.&#8221;</p>
